Cup Classics Competition Terms and Conditions

  1. How to enter
    1. Create your video – you can be as creative as you like but the work must be original (you cannot use footage produced by other people) and you should have the permission of any identifiable people appearing in the video to include them. Your video should be no more than 2 minutes long and also comply with our content standards (see below).
    2. Once you’ve made your own video, upload it to YouTube, which will generate an embed code for you. You should also tag the video “CupClassics”.
    3. Complete the registration form on the “Enter Now” page on the Cup Classics website – you will need the YouTube embed code in order to include your video.
    4. Encourage your friends, family, workmates and people you meet randomly in the pub to log on to the Cup Classics website and vote for your entry!
    5. There is no purchase necessary to enter the Competition and entry is free but entry requires that entrants submit some basic registration information, (including name, street address, email address, and date of birth) and comply with the Competition Terms and Conditions.
  2. Competition Terms and conditions
    1. No purchase necessary. Entry to the Competition is free and must be made by submitting your video with your name and contact details to the URL above. All entries must be submitted in the name of an individual person and the prize can only be awarded to the person whose name is on the winning entry.
    2. There are no limits to the number of entries you can submit to the Competition. Each entry must be entered separately on the Cup Classics website
    3. The Competition commences on 14th May 2010 and will end at 11.59p.m. 6th June 2010. All entries must be received by the closing time and date set out above in the United Kingdom.
    4. The winners will be selected on the basis of votes cast on the Cup Classics website. Voting is subject to the Voting Guidelines set out below. At the sole discretion of the operators of www.cupclassics.co.uk, whose further details are set out below (the ‘Operator’), entries may be discarded they do not comply with the Competition Terms and Conditions or the Content Standards. One winner and five runners up will be announced prior to 9th June 2010. No correspondence will be entered into. The selection of all winners will be at the sole discretion of the Operator and the Operator’s decision will be final.
    5. Full prize details available on request. Prizes unclaimed after twenty eight (28) days will be deemed to have been forfeited and the Operator reserves the right to either offer the prize to other entrants or re-offer the prize for future competitions of the Operator.
    6. Persons connected with or to the Operator, or contractors, or any of the Competition sponsors, (including employees and immediate members of their families) are ineligible to enter the Competition.
    7. Any entry which is late, incomplete, illegible or otherwise does not comply with the rules may be deemed invalid on the sole discretion of the Operator. The Operator is not responsible for and shall not be liable for telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, delays or difficulties and errors in transmission or any prize deliveries attempted but not received.
    8. All entries must be the original work of the entrant, who must have full ownership of the work and all related rights. All entries will become the sole property of the Operator, including all rights to use any entry, or portion of an entry for any purpose without consideration to the entrant.
    9. The prizes are non-transferable and no cash alternative will be offered. In the event of the advertised Competition prize being unavailable, the Operator reserves the right to offer an alternative prize of equal or greater value without notification.
      • The Operator is not responsible for the operation or installation of prizes following delivery. Please note in certain buildings it is not possible to install a satellite dish and in certain parts of the UK Freeview or Freeview HD may not be available.       • Proof of age may be required prior to delivery of any prizes which contain alcohol or are subject to any legal age restrictions.
      • The winners are responsible for any taxes, transfer fees, or other expenses that might result from accepting the prizes.
    10. The Operator accepts no responsibility for any failure to fulfil its obligations arising out of circumstances outside its control. Such circumstances shall include, but not restricted to terrorist attack or incident, government regulation, regulatory action, accident, war, riot, natural disaster, explosion, fire, weather or strike, events affecting the operation of the Competition including in the event that the Operator’s website is infected or affected by a virus, bugs, unauthorised human intervention, or other causes beyond the control of the Operator, in the Operator’s sole opinion, or the occurrence of any matters which corrupt the administration, security, fairness, integrity, or proper operation of the Competition or for any other reason at the sole discretion of the Operator. The Operator reserves the right to suspend or cancel the Competition in the event of occurrence of any cause beyond its control.
      • In the event of cancellation, the Operator may, in its sole discretion, elect to award the prize to a winner randomly drawn from among all participants who had validly entered the Competition at the time of such cancellation.
    11. The Operator reserves the right to use Competition entrant’s personal details for any commercial purpose and to publish relevant personal details of the Competition winners in various media for publicity purposes. Competition Winners may be required to take part in or cooperate with the Operator in relation to related publicity.
    12. Entry into the Competition constitutes acceptance of the rules. The Operator reserves the right to amend the rules of this Competition at anytime. Any winner who does not comply with the rules of this Competition will be disqualified.
    13. The Operator may require winners to provide proof that they are the authorised account holders of the email addresses used to enter the Competition. This means that the winner is the natural person who is assigned to an email address by an Internet service provider, online service provider, or organisation that is responsible for assigning email addresses for the domain associated with the email address.
    14. Each entrant’s details will be kept by the Operator for a reasonable period and the Operator, its agents and service providers will use it to verify compliance with the rules and to deliver any prizes. The entrant consents to the Operator’s use and processing of the entrant’s personal data in connection with the Competition. The Operator may use such details to let the entrant know about other products and services which they think may be of interest to the entrant. If you do not wish to receive such information please inform the Operator in writing at the address below. Any information or data provided on this website will be managed by the Operator, but may be collected and maintained outside of the United Kingdom by service providers.
    15. This Competition is administered by the Operator whose details are set out below. Details of the winners can be obtained by sending an electronic mail to competition@wildfirepr.co.uk or a self-addressed stamped envelope to the Operator’s address details below.     16. Entrants must be over 18 years old.
    17. The Operator shall be entitled to request any entrant or winner to present themselves personally and/or provide suitable or specified evidence of their identity and address prior to provision of any prize. Use of false details (name and address) will result in disqualification of any person from receiving any prize.
    18. Any entrant or participant by entering into the Competition agrees not to cheat and agrees to abide by these rules and will be responsible for and indemnify the Operator from and against any loss, liability or damages suffered by Operator in connection with a submitted design or related to participation in the Competition.
    19. All decisions by the Operator relating to this Competition shall be final and binding. Any provisions of these rules deemed unenforceable by a competent court or relevant regulator will be enforced to the extent permissible and the remainder of the provisions of these Terms and Conditions will remain in effect.
  3. Content Standards
    1. Entries must comply with following standards. Entries which do not comply with these standards will not be included on the Cup Classics website.

      Entries must not:

      • Contain any material which is defamatory of any person.
      • Contain any material which is obscene, offensive, hateful or inflammatory.
      • Promote sexually explicit material.
      • Promote violence.
      • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
      • Infringe any copyright, database right or trade mark of any other person.
      • Be likely to deceive any person.
      • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
      • Promote any illegal activity.
      • Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
      • Be likely to harass, upset, embarrass, alarm or annoy any other person.
      • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
      • Advocate, promote or assist any unlawful act.
  4. Voting Guidelines
    1. Votes may be cast online by visiting www.cupclassics.co.uk and following the onscreen instructions.
    2. Voting will start at 9a.m. on 14th May 2010 and be closed at 11.59p.m. on 6th June 2010. Votes made or received outside of these specified times will not be counted. Voting times are liable to change and the Operator may suspend, withdraw or re-set voting at its sole discretion at any time. The Operator may in its sole discretion at any time change the rules for voting.
    3. Each person may only vote online once per browser session. There is no charge for voting although you may be charged for accessing the internet.
    4. The Operator is committed to operating voting fairly, and to preventing abuse of its systems. Hence, the Operator reserves the right to discount votes if it has reasonable grounds to suspect, at its sole discretion, that fraudulent voting has occurred, such that is designed to excessively manipulate the outcome of the vote or votes have been cast in breach of these guidelines.
    5. Voting is intended for individuals as consumers. The Operator reserves the right to discount votes if they have reasonable grounds to suspect those votes have not been made by consumers (for example by agencies, businesses and/or companies).
    6. The result of the vote to determine the winner of the Competition will be determined by the total number of votes received by the closing date and time.
    7. In the event that the outcome of the vote cannot be reasonably determined because of a technical failure or other circumstance beyond the Operator’s reasonable control which affects the vote, or any other decision which the vote would have determined, then the votes which have been received by the closing date and time will be used to determine the winner. If no votes have been received, then the Operator will decide which entries win or any other decision which the vote would have determined, having regard to all circumstances and information available to them. The Operator’s decision will be final.
    8. The Operator cannot promise that the services will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. The system and/or service may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the reasonable control of the Operator. The Operator will not be liable to you or to any other person in the event that all or any part of the system and/or services are discontinued, modified or changed in any way.
    9. The Operator, its client and affiliates and their sub-contractors bear no responsibility for any technical failure, interruption or malfunction or any other problem with any telephone network or line, system, server, software, provider or otherwise which may result in any online votes not being properly received, registered or recorded.
    10. Nothing in these terms and conditions restricts your statutory rights as a consumer. For more details on your statutory rights you should contact your local Trading Standards Office or Citizen's Advice Bureau.

Competition winners agree to keep confidential any knowledge about the Operator and its associates, their respective businesses and personnel which they receive or obtain as a result of the Competition.

By entering the Competition the entrant, will be deemed to have read and understood these rules and instructions and to be bound by them.

The Competition is only open to residents of the United Kingdom and is governed by English law. Disputes in connection with the rules or this Competition shall be subject to the jurisdiction of the English Courts and by entry into this Competition, the entrant submits for the benefit of the Operator to the exclusive jurisdiction of the Courts of England and waives all rights to object to forum. The Operator shall be entitled to commence or pursue proceedings in any jurisdiction, whether concurrently or not.
